Plaintiff’s bodily injury claims dismissed when pre-accident MRI’s demonstrated there we no new injuries
Jeffrey Murray and Magdich Law successfully obtained summary disposition of a negligence claim against our client. Plaintiff alleged she had sustained serious injuries to her neck and lower back following a minor motor vehicle accident. After a thorough investigation, it was discovered that Plaintiff’s alleged injuries actually arose through a separate accident two years prior. This includes identical before and after MRI studies of the plaintiff’s spine, each showing consistent degenerative injuries. Reviewing the record, Judge Jarbou agreed that there was no evidence of a novel injury or exacerbation, and that Plaintiff had failed to meet her burden. With no remaining questions of fact, the case was dismissed with prejudice.
