Motion for Summary Disposition granting dismissal of Plaintiff’s claim for failure to meet threshold requirements
Alysha Warren and Magdich Law won summary disposition pursuant to MCR 2.116(C)(10). Plaintiff filed suit claiming injuries as a result of a motor-vehicle accident. Defendant argued that Plaintiff did not sustain an objectively manifested impairment, as well as experience any effect on his ability to lead his normal life, as required by MCL 500.3135 and McCormick v Carrier, 487 Mich 180, 195; 795 NW2d 517 (2010). The Court agreed with Defendant and ruled that the Defendant conclusively showed Plaintiff did not meet the necessary requirements. Plaintiff’s claims against Defendant were dismissed.
