With our unique knowledge of the trial process and how it affects the appellate process, we handle all appeals in house. This saves the client the cost of having to pay yet another firm to learn the case from the beginning and write an appeal. In addition to handling our own appeals, in many cases we take over cases following an unsuccessful trial and we see the case through the appellate process.
We are also retained by third parties who are taking an interest in the pending appeal and may file an Amicus Brief on their behalf.
CASE IN POINT:
Karen Magdich was retained by Allstate to oversee the post trial motions and appeal following an unsuccessful trial handled by another firm. When the trial court denied the post trial motions, Magdich & Associates reviewed the trial and the arguments presented to the trial court. We prepared the Brief to the Michigan Court of Appeals. The Court of Appeals sided with the trial court on most issues. We did not stop there. We believed that Allstate was within its rights to deny coverage. We sought an appeal to the Supreme Court which was granted. The Supreme Court overturned the Court of Appeals and Trial Court and agreed with Allstate and Magdich. The matter of Frazier v. Allstate, 490 Mich. 381, 808 N.W.2d 450 (2011), is now an often cited opinion in matters involving parked motor vehicles.
